Definitions

 

In these Conditions of Sale:-

  1. "Base Preparation" means preparation of the site and construction of a flat, firm and level base with an area, depth, strength and durability adequate to support the building.
  2. "Building" means the building or structure or the parts thereof described on your order.
  3. "Installation / Erection means the work necessary to install the building upon the customers prepared site and "install" shall be construed accordingly.
  4. Elite Garden Buildings Ltd is abbreviated in these Conditions of Sale to EGB

Warranties and Liability

  1. It is the intention of the company that all terms and conditions of the contract between the Customer and the Company are contained on the written order form, brochures, price list and specification (if any) provided to the customer. If the customer wishes to rely on any other variation other than these terms you are asked to ensure that such variations are written into your order as soon as possible after the order has been signed.
  2. Display Buildings when purchased are not in perfect condition and are sold as seen. Customers should check that the goods are of a satisfactory condition for their particular use and requirement. Display buildings and buildings which are substandard and sold at discount prices will be identified and will be stated to be sold as such.
  3.  As soon as we have delivered the goods or services, you will be responsible for them. If you delay a delivery, our responsibility for everything other than damage due to our own negligence will end on the date we agree to deliver the goods as per the sales order.
  1. The Purchaser will be responsible for all sizes / measurements given to the company unless EGB have surveyed the site and supplied the measurements on behalf of the customer.

Timber buildings

All timber buildings (including softwood, cedar, factory painted and tantalised) will benefit from regular maintenance to the timber, hinges and handles to prolong the service life of your building.
The building should be treated regularly to protect it from the weather and water ingress to the timber.Ventilate your building whenever possible to prevent the build-up of condensation by leaving doors/windows open. This will allow any condensation to evaporate and help avoid any water that may gather inside.

Tanalised timber buildings do require treating as soon as possible after installation and periodically thereafter.
We recommend that upon purchasing your tanalised timber building you have full knowledge and understanding of your product and accept the following as highlighted in your terms and conditions.
The process of tantalising and pressure treating means the timber is protected against fungal attack and rot which can cause wood decay. The Tanalised Range of buildings are constructed using tantalised, pressure treated timber throughout.
For your understanding, the process of tanalising and pressure treatment does not mean that your building will be waterproof.
We would highly recommend you apply an oil based waterproofing treatment within a week of your installation to make the timber watertight and periodically thereafter.

Regency softwood buildings are supplied dipped treated (inside and out) with a base coat which is a sprit based treatment and golden oak in colour. We would recommend a further coat of treatment within 4 weeks of delivery/installation.

Factory painted buildings. Great care is taken when painting your building to achieve the best result and finish. Please be aware that knots will show through the paint (more so on lighter colours). This is a natural process and cannot be avoided. We cannot guarantee against this happening even though the paint system used does include knot inhibitors. Sap/resin on softwood buildings may come to the surface and raise the finish. This is a natural process and can be resolved by following the maintenance guide.
Factory painted building do need inspecting periodically. Any defects should be touched up using the tin of touch up paint supplied at the time of delivery and following the maintenance guide.

Due to natural weathering over time, subsequent treatment may darken down the building and give a different appearance than expected. Treatment vary in range and final finish. If in doubt always use a test patch in an inconspicuous area for final results.

Placing an order

You are deemed to have placed an order with us by ordering online via our secure online checkout process or by placing an order over the telephone.
If paying by card we will not ask you for your card details. Payments will be made via the secure checkout process or via a secure payment link.
Your order will be checked and confirmation will be sent by e-mail.
Written confirmation will be sent by post on request.

Please use the Order Notes for anything relevant to your order and its safe delivery/installation. This may include but not limited to: anything non-standard, information regarding access, delivery/installation availability, anything you are unsure of regarding your order.

We may not be able to accept your order:

a. Where goods are not available
b. If there has been a pricing or product description error
c. Where we cannot obtain authorisation for your payment.
d. Where it is logistically impossible for us to deliver the goods to that location, or where additional service fees apply

The Company shall notify The Customer should their order not be accepted and inform them of any changes and/or additional charges.

Should the customer accept any revision to their order the order will be accepted and processed. If declined The Company will cancel the customers order and refund all monies received.


Price

The Price of the goods will be stated on your Order in £ sterling and inclusive of VAT.

If you request EGB to Install your building the price will be shown separately as per our price list, this price is for the installation of the building only and does not include any groundwork or base work preparation costs, this work will remain the responsibility of the customer unless EGB agree to carry out this base work preparation once having surveyed the site in question and at separate cost.

Payment Terms

When an order is placed through our website payment must be made in full at the point of order. On-line and telephone order payments are processed via a secure payment system.
Where a deposit has been agreed and paid any remaining balance must be made prior to delivery.
Payment can be made via debit or credit card.
We also accept payment via Bank Transfer.

Time for payment shall be of the essence and any failure to pay shall entitle us at our option to treat the contract as repudiated by the customer, to delay delivery until paid or appropriate any payment made by the customer to such of the Goods as we may think fit, notwithstanding any purported appropriation by the customer (without prejudice to any other remedy that the Seller may have). Receipts for payment shall be issued only on request.

You must tell us of any defect in the goods as soon as reasonably possible.

Dimensions, Specification and Accuracy

Whilst we endeavour to give customers every possible means of making an informed decision including brochures, website content and our customer service, it is not always possible to give every exact specification or dimension found on a building or product and on occasion manufacturers may amend the specification of their products without our prior notification. With timber products all measurements will be classed as approximate and nominal as wood is a natural product and is subject to expansion and contraction.

If you are at all concerned as regards a product specification, dimensions, suitability or quality then please contact us to clarify your concerns.

Any large building/sections (above about 3050mm (10’)) may be manufactured in more than one piece for ease of access and transportation.

Photos are for illustrative purposes only and any illustrations contained in our catalogues, brochures, emails or on our website are produced for general information only and should not be relied upon or used as the sole basis for making decisions about the goods they describe and/or are representative of the finished product.
Photos/illustrations may not be the size of building you require and may show optional extras available at an additional cost.
This may include but not limited to:
Garden Buildings, additional windows, a different window style, roof felt/cedar tiles, colour painted, cedar/softwood cladding.
Green houses: colour powder coated, shelving/staging, auto openers, base plinth

Actual colours may vary due to the calibration of the phone/screen they are displayed on.

Deliveries.

Garden Buildings:
For Garden Buildings (not greenhouses) local delivery (mainland) is included within the price. Delivery will typically be made by EGB. If an out of area delivery is agreed a delivery charge may apply which you will be notified of prior to placing an order.

Greenhouses:
For Greenhouses and any greenhouse accessories ordered together, delivery is included for most mainland UK areas. There may be an additional delivery charge for Scotland, off shore islands and some areas of England and Wales. Greenhouses are typically arranged and delivered direct from the manufacture.
For greenhouse accessories and or spares not ordered separately a delivery / postage charge will apply.

For direct deliveries (and or installation) individual manufacturers specific terms and conditions may apply and will be supplied prior to any delivery and or installation taking place.

Estimated Lead times and Delivery dates are given in good faith and time is not the essence of the contract.

Estimated Lead times given in good faith at the time of order may be extended during the peak season (April to August) by suppliers at short notice.

The delivery service for all buildings is to the front of the property only or nearest convenient area by the property. We and/or the manufacture will arrange the day with you (week days excluding bank holidays) but cannot guarantee a delivery time.

Access must be clear of obstructions with no height restrictions, multiple steps or sharp bends along any access route. Panels can be up to about 3.0m (10’) long and or upto 2.5m (just over 8’) in height.

If access is restricted please let us know at time of order. Panels can be made in smaller sections, at an additional cost, where required due to restricted assess. This must be stated at time of order and detailed on your order.

It is The Customers responsibility to provide unobstructed access for the delivery to take place. Any failed or returned deliveries may result in additional charges being passed to The Customer.
Notification of delivery may be made by telephone call/message, email, fax or by post direct from the manufacturer, carrier or ourselves.

Any delay in delivery does not entitle you as a customer to any compensation. EGB will not be liable for any loss or damage suffered by the Purchaser through any reasonable or unavoidable delay in delivery howsoever caused including third party work booked prior to receiving the building.

All deliveries must be checked and signed for at time of delivery. Any shortages, damages or broken items must be noted on the delivery note and photographed.

Returns Faulty Goods

If the product is damaged or broken on arrival you can return the goods for a full refund or have any broken or damaged parts replaced. It is imperative that if any part of your order is damaged then a photo should be taken of the product.
Damage should be reported within a reasonable time of delivery and we may request photographic evidence of the condition of the damage or faulty item, you should not attempt to fit or modify the product in anyway and must retain the original packaging.
In the case of larger products such as garden buildings or greenhouses we will arrange collection the goods or for any replacements required. For smaller items it may be necessary for The customer to return them to  EGB or the manufacturer by post.
It is the responsibility of the customer to retain possession and take reasonable care of the goods until they have been returned to the possession of; The Company, the manufacturer or their appointed carriers. We cannot accept back for a full refund any item which has been assembled or modified in any way.
If on return the product is found to be of merchantable quality, complete and as described for sale, any return charge will apply and will be deducted from the order monies held at cost.
Reimbursement of rejected goods, less any charges defined above, will be made to the customer as soon as possible and certainly within a period not exceeding 30 days from the date of return.

Where goods are returned, this must be during normal trading hours. Please state the order number and date.

Returns Cancelled Orders

For online and telephone orders the customer has a right to cancel the order without giving a reason within 14 days of receiving the goods. The customer has a further 14 days to return the goods.

If you would like to make a return, just call us on 01962 714141 or email info@elitegardenbuildings.co.uk and we can arrange the return of the product with you. The customer is responsible for the return costs. All bespoke and made to order products cannot be returned.​​​​​​​​​​​​​​

Cancellations should be sent by email, by telephone or by registered post to 'The Company' trading address, quoting the order reference given when the order was placed.
In the case of larger products such as garden buildings and greenhouses, we will arrange collection of the goods by EGB or with the manufacturer. For our smaller items it may be necessary for the customer to return them to EGB or the manufacturer by post.
It is the responsibility of The Customer to retain possession and take reasonable care of the goods until they have been returned to the possession of, The Company, the manufacturer or their appointed carriers. We cannot accept back for a full refund any item which has been assembled or modified in any way.
It is the responsibility of The Customer to meet all product return costs and where The Company is arranging collection the customer will be notified of the return charge prior to undertaking the process.
Reimbursement of cancelled orders monies, less any charges defined above, will be made to the customer as soon as possible and within a period not exceeding 14 days from the date of return.

Storage

Space in our warehouse is very limited and goods cannot be stored there for longer than 4 weeks after you have been notified that they are ready for collection / delivery.

Buildings that are not collected / delivered within that period will be subject to a storage charge of £25.00 per week.

If you do not require your order within the estimated time frame and would like a delayed delivery, please let us know at the time of order. We will coordinate the manufacture of your order with the delayed delivery.

Installation

If the Goods are to be installed by EGB at the customer's property the customer must ensure that the base area is flat, firm and level. If in EGB's reasonable opinion the ground is not appropriate for the future well-being of the building, EGB shall be entitled to remove the Goods from the customers property and the customer shall be responsible for rectifying the ground and for the additional cost of a return visit on a later occasion. The return charge will be 50% of the initial installation fee. Installation charges do not include any Base Work Preparation and assume a reasonable walk through access and distance not exceeding approximately 50 metres to the installation site with no height restrictions.

Access

It is the responsibility of the customer to ensure that reasonable and safe access is made available to the erectors. If any obstruction needs to be removed to enable access such removal will be at the entire risk of the customer. The customer hereby grants reasonable access to EGB to come onto the customers property to deliver the goods. If EGB are unable to gain safe and reasonable access EGB will be entitled to leave the Goods (if paid for in full) and return at a later date when access is made available and the return charge of 75%                                                                                                                                                              of the original list price, installation fee is paid by the customer.

Timber Products

The customers attention is drawn to the fact that timber products by their nature may not be waterproof and water based treatments may not stop the ingress of water. Most timber buildings will be dipped in a preservative treatment prior to delivery, EGB recommend an additional applications of a good quality timber treatment to preserve its appearance and protect against the elements. Timber buildings will expand when wet and shrink when dry, this will be kept to a minimum by good maintenance and treatment process, doors frames may warp slightly but can usually be corrected by fitting a turnbuckle top / bottom.

Guarantee

EGB will guarantee the building for a period of 12 months from date of purchase against qualifying defective materials and will repair or replace such parts at its own expense provided the customer has taken reasonable care of the building during that period. This offer does not extend to glass products, knots or imperfections in timber associated with the grade of timber used for the goods purchased.

Nothing in these terms and conditions affect you statutory rights relating to goods or services provided. If you have any doubts about your statutory rights contact your local Trading Standards Office or Citizen's advice Bureau.
